Company Formation Update: The S243 option
We’re constantly looking at ways that we can improve our company formation process, making it easier for our customers to successfully set up their limited companies. The latest update that helps ensure this is the removal of the ‘S243’ option from the Director Appointment section of the report.
The S234 tickbox was for customers subject to a diAsclosure exemption, meaning they don’t have to give their residential address when forming the company. As Companies House put it:
Disclosure Exemption
This is an exemption from disclosing the director’s usual residential address to credit reference agencies. It only applies to director’s who have been granted a disclosure exemption under section 243 of the Companies Act 2006. The disclosure exemption will also apply to those who have a Confidentiality Order (section 723b of the Companies Act 1985) in place on 01/10/09.
The problem was that the box was being ticked when it shouldn’t have been – which would then lead to the company formation application being rejected by Companies House. Therefore, because the number of people that ticked the box when they weren’t supposed to far outweighed the number of people that actually needed to use it, we decided to remove the option.
